Although we retain our rights in and to the content that is present on the website or that may be created and/or supplied by or for us, we take no ownership in any material uploaded or submitted to the website or placed by you or others in your project. We have no control over, and no knowledge concerning, material you submit. Accordingly, you bear the legal responsibility of ensuring that none of the material that you upload , submit or include in your project infringes copyrights or any other legal rights of others.

Thus, in uploading or submitting any materials to the MyCanvas website, you agree, represent, and warrant that you are not uploading or submitting any of the following (hereinafter collectively referred to as "Unauthorized Materials"): (a) materials that are unlawful, threatening, abusive, defamatory, obscene, or that invade another person's privacy or further the commission or concealment of a crime; (b) materials that are not lawfully yours to transmit; (c) materials that are the subject of, or that infringe upon, any copyright, patent, trademark, trade name, trade secret, right of publicity, moral right or other intellectual property right of another person or entity; and/or (d) materials containing software viruses or other harmful computer code or that in any way interfere with or disrupt the services or any servers or networks connected to or used with the services provided by us. In addition, in uploading or submitting any materials to the our website, you must also agree, represent, and warrant that you own the copyright or have permission to copy any photographs, artwork, templates or “scans”, poetry, or other things used in any material you submit to this website.

By checking the "I Accept" box, you confirm the above and that you will defend, indemnify, and hold harmless us and our officers, directors, agents, and employees from any suit, demand, claim, or damages arising out of any breach of this warranty and agree to pay any judgment or reasonable settlement offer resulting from any such suit, demand, or claim, and to pay any costs, liabilities, and attorney's fees incurred by us in defending against such suit, demand or claim.

Although it has no obligation to do so, we reserve the right to review material submitted to this website to attempt to evaluate whether it may infringe the intellectual property or other legal rights of any third parties.
